Terms of Service
The terms that govern your use of our websites, forms, and appointment text messages.
These Terms of Service ("Terms") are an agreement between you and PeakOps, Inc. ("PeakOps," "we," "us") and govern your use of peakops.net, the public pages of app.peakops.app, our intake and booking forms, and our appointment text-message program. By using these sites or submitting a form, you agree to these Terms. If you engage PeakOps for services, that engagement is governed by a separate written agreement; these Terms cover the websites and communications around it.
Who we are
PeakOps builds verified operational records for field-service and construction businesses — turning field evidence into closeout packets built to what payers actually accept. Content on these sites is provided for general information about our services and industry topics; it is not legal, accounting, or financial advice.
Using our sites
- You may use our sites only for lawful purposes and in a way that does not interfere with their operation or with anyone else's use.
- You agree not to probe, scan, or test the vulnerability of the sites, scrape them at abusive volume, submit false or misleading information through our forms, or impersonate another person or business.
- You must be at least 18 years old and acting on behalf of a business to submit our intake or booking forms.
Appointment text messages (SMS)
PeakOps operates a single, appointment-only SMS program. By checking the SMS-consent box on one of our forms, or by otherwise asking us to text you about an appointment, you agree to the following program terms:
- Message types. Booking confirmations, appointment reminders, rescheduling notices, and cancellation notices only. We do not send marketing or promotional text messages under this program or any other.
- Message frequency varies with your appointment activity.
- Message and data rates may apply, depending on your mobile carrier and plan. Carriers are not liable for delayed or undelivered messages.
- Opt out at any time by replying STOP to any message. After you opt out, we will send one final message confirming the opt-out and then stop texting you.
- Help. Reply HELP to any message, email nick@peakops.net, or call (509) 309-8250.
- Consent is not a condition of purchase of any PeakOps product or service. You can decline appointment texts and we will confirm and remind by email or phone instead.
- Service providers (our CRM and telecommunications providers) receive your mobile number and message content only to deliver these messages on our behalf, and for no other purpose. See our Privacy Policy for details, including how consent records are kept.
Intellectual property
The sites and their content — text, design, graphics, and code — are owned by PeakOps or its licensors and are protected by intellectual-property laws. You may view and share links to our content; you may not republish it commercially or pass it off as your own without our written permission. "PeakOps" and the PeakOps mark are trademarks of PeakOps, Inc.
Third-party links and services
Our sites link to third-party services (for example, our scheduling pages). Those services have their own terms and privacy policies, and we are not responsible for their content or practices.
Disclaimers
The sites and all content on them are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the sites will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, PeakOps will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the sites, and our total liability for any claim relating to the sites will not exceed one hundred U.S. dollars ($100). Nothing in these Terms limits liability that cannot be limited by law. Liability arising from a paid services engagement is addressed in that engagement's agreement, not these Terms.
Indemnification
You agree to indemnify PeakOps against claims arising from your violation of these Terms or your misuse of the sites.
Governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the sites will be brought in the state or federal courts located in Washington, and you consent to their jurisdiction.
Changes to these Terms
We may update these Terms from time to time. The current version will always be posted at this address with its effective date. Changes to the SMS program terms will be communicated before they take effect. Continued use of the sites after changes take effect constitutes acceptance of the new Terms.
